These Terms of Use ("Terms") govern your access to and use of the Digible iOS application and related services (the "Service") provided by Agape Labs Ltd ("Agape Labs", "we", "us", "our").

By downloading, installing, or using Digible, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Eligibility

Digible is intended for users aged 13 and over. If you are under 13, you may not use the Service. If you are in a jurisdiction with a higher age of digital consent, you must meet that age requirement or have verifiable parental consent.

Your account

You may create an account using Sign in with Apple or email and password. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us promptly at team@agapelabs.co.uk if you suspect unauthorised use of your account.

Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Post, share, or transmit content that is abusive, harassing, threatening, obscene, defamatory, or otherwise objectionable.
• Infringe upon the intellectual property or other rights of any third party.
• Attempt to gain unauthorised access to the Service, other accounts, or any related systems or networks.
• Interfere with or disrupt the integrity or performance of the Service.
• Use automated means (bots, scrapers, etc.) to access or collect data from the Service without our written permission.
• Impersonate any person or entity, or misrepresent your affiliation with a person or entity.

User-generated content

Digible allows you to create and share annotations, comments, and other content ("User Content"). You retain ownership of your User Content. By posting User Content, you grant Agape Labs a non-exclusive, worldwide, royalty-free licence to host, display, and distribute your User Content solely for the purpose of operating and providing the Service.

We may remove User Content that violates these Terms or our community guidelines, and may suspend or terminate accounts responsible for repeated violations.

Intellectual property

The Service, including its design, features, code, and branding, is owned by Agape Labs Ltd and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service except as expressly permitted by these Terms.

Bible text displayed within the app is used under licence or in accordance with the terms of the respective rights holders. The specific licence or copyright notice for each translation is displayed within the app.

Subscriptions and purchases

Certain features of Digible may require a paid subscription or one-time purchase, processed through Apple's App Store. All payments are handled by Apple and subject to Apple's terms and conditions. We do not directly process payment information.

Subscription renewals and cancellation are managed through your Apple ID settings. Refund requests should be directed to Apple in accordance with their refund policy.

Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

Availability and changes to the Service

We aim to keep Digible available and reliable, but we do not guarantee uninterrupted or error-free access. We may modify, suspend, or discontinue any part of the Service at any time without prior notice. We are not liable for any modification, suspension, or discontinuation.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be secure, error-free, or free of viruses or other harmful components.

Limitation of liability

To the fullest extent permitted by applicable law, Agape Labs Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or in connection with your use of the Service, whether based on contract, tort, strict liability, or any other legal theory.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

Indemnification

You agree to indemnify and hold harmless Agape Labs Ltd, its officers, directors, and employees from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may stop using the Service at any time. You can delete your account through the in-app settings or by contacting us at team@agapelabs.co.uk.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will remain in effect.

Governing law and disputes

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales. Nothing in these Terms affects your statutory rights as a consumer.

Changes to these Terms

We may update these Terms from time to time. The updated date will be posted at the top. For material changes, we may provide additional notice in-app. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
